In summary

Quando si causa un incidente stradale in stato di ebbrezza alcolica le pene suddette sono raddoppiate ed è disposta la confisca del veicolo (salvo appartenga a persona estranea al reato).

Visita medica presso la Commissione Medica Locale.
Con l’ordinanza di sospensione della patente il Prefetto dispone anche che il conducente si sottoponga a visita medica ai sensi art.119 CDS entro 60gg, trascorso tale termine o nel caso il tasso alcolemico sia >1,5 g/l il prefetto può disporre la sospensione della patente fino all’esito della visita medica.

Rifiuto dell'accertamento (preliminare, con etilometro o sanitario)
Il rifiuto dell'accertamento viene punito con le stesse sanzioni previste dal comma 2 per il tasso alcoolemico superiore a 1,5g/l

Art.6 bis della Legge 160/2007
Quando la guida in stato di ebbrezza alcolica è accertata nelle ore notturne (dopo le ore 20,00 e prima delle ore 7,00) sarà applicata una sanzione amministrativa aggiuntiva di 200 euro. Tale disposizione non è ancora operativa in quanto manca il regolamento di attuazione che non è ancora stato emanato.

Art. 15 comma 1 della Legge n. 125 del 30/03/2001 e Provvedimento della Conferenza Stato Regioni n. 2540 del 13/03/2006
La legge 125 vieta l’assunzione o la somministrazione di bevande alcoliche o superalcoliche in activities involving high risk of accidents at work or for security, safety or health of others. The measure
