know better penalty system of CDS

Most CDs are illegal under the Administrative Offences.
Per illecito amministrativo si intende la violazione di una norma giuridica, in questo caso delle norme contenute nel codice della strada, cui viene comminata una sanzione amministrativa pecuniaria.

Quando la violazione ad un articolo del codice prevede una sanzione essa è composta:
  • sempre da una sanzione amministrativa pecuniaria principale e in alcuni casi anche da una sanzione amministrativa accessoria non pecuniaria tra quelle previste dal codice della strada stesso.

Attenzione la sanzione accessoria non è in alternativa a quella pecuniaria e quando è prevista viene sempre applicata (si dice che viene applicata di diritto art.210 Cds).

Le sanzioni accessorie sono disciplinate by specific articles of the CDS and are grouped into three areas.
  • obligations to perform a particular task or to suspend or cease an activity:
    • obligation to restore the condition of the premises or removal of unauthorized works art.211;
    • detreminata an obligation to suspend activities Article 212.
  • sanctions related to the vehicle:
    • seizure art.213;
    • vehicle impounded art.214;
    • remove or block the vehicle art.215.
  • punishment of the vehicle documents and driving:
    • withdrawal of documents circulation, plate or driver's license Art.216;
    • suspension of the registration certificate art.217;
    • license suspension art. 218;
    • art.219 revocation of the license.
Very few are criminal offenses under the code, they are:
  • 9a c1 and c4: organizing, promoting, directing or otherwise facilitating a competitive sport in speed with a motor vehicle without authorization, or bet on these races;
  • 9b c1: outside the confines of Article 9-a, anyone who competes in speed with a motor vehicle;
  • 100 c14: falsify, tamper with or alter license plates or license plates using tampered, falsified or altered (including the license plates of farm machinery Art.113 c5);
  • 116 c13 : drive or motor vehicle without having obtained a driver's license or license revoked or not renewed due to lack of requirements in the event of re-offending within two years.
